blablaType End User License Agreement (EULA)

1. What the license is and what it gives you

We grant you a non-exclusive, non-transferable, revocable license to install and use the blablaType app on devices running Windows. The license is valid for as long as you use the app on the free plan, and for the duration of any paid subscription (Pro or Max), which renews automatically together with the subscription.

The license permits personal and work use. On the free plan you can dictate text with automatic punctuation, within the monthly allowance. On the Pro plan you can also translate speech on the fly, clean filler words out of your speech and use the corrections dictionary. On the Max plan you can additionally use voice commands over selected text and send-as-you-speak. The set of available features depends on your plan.

The app is licensed, not sold. All rights to the program, its code, design, name, and accompanying materials belong to blablaType. No ownership rights to the program pass to you, other than the right to use it under the terms of this agreement.

2. Free plan and subscription

The free plan does not expire and no bank card is required for it. It allows 60 minutes of recognised speech per calendar month; the allowance resets on the first day of each month (UTC). When the allowance is used up, dictation pauses until the next month, or until you take out a paid subscription.

Subscriptions are available on the Pro or Max plans under the terms described in the Terms of Service. A paid license under this EULA is valid for as long as the subscription is active: if you cancel the subscription, you keep access to the paid features until the end of the paid period, after which the account returns to the free plan.

The app requires an account (an email address and a hashed device identifier) and an internet connection: speech recognition runs on the server. Without internet access, recognition features are unavailable.

3. What is prohibited

You may not decompile, disassemble, or otherwise reverse engineer the app, or attempt to extract its source code, except where such a right is expressly granted to you by law and cannot be restricted by contract.

You may not sell, resell, rent out, or lease the app or access to it, lend it to third parties free of charge, transfer the license, sublicense it, or provide the app as a service to third parties.

You may not bypass or disable technical protection measures, plan limits and the free plan's allowance, or the mechanisms that tie the app to your account and device, and you may not create multiple accounts or spoof the device identifier to obtain the free plan's allowance again.

You may not modify the app, create derivative programs based on it, remove or hide copyright notices, use the blablaType name and materials for your own products, or use the app to break the law or violate the rights of third parties.

4. App updates

The app may automatically download and install updates: bug fixes, security improvements, and new or changed features. By agreeing to this EULA, you agree to receive such updates.

We may change, add, and remove individual features of the app, including as part of developing the plans. The app may need to be up to date to work correctly and securely: support for outdated versions may be discontinued.

5. Data and privacy

When you dictate, audio is transmitted over a secure connection (HTTPS) to the blablaType server and passed to a speech recognition provider; after processing, the audio is not stored. The recognized text is returned to you and is not stored on the server. Text features (speech cleanup, translation, commands) process only text that has already been recognized.

6. The software is provided "as is"

The app is provided "as is" and "as available", without any warranties, express or implied, including warranties of fitness for a particular purpose, uninterrupted operation, and freedom from errors, to the maximum extent permitted by law.

Speech recognition and translation are performed by automated systems and may contain inaccuracies. You check the result yourself before using it, especially in important texts: work documents, legal and financial materials.

The app's operation depends on your internet connection, your Windows system, and third-party recognition providers. We do not guarantee that the service is available at every moment in time. To the extent permitted by law, our liability under this agreement is limited to the amount you have paid for the subscription over the last 12 months. Mandatory consumer rights under applicable law are not affected by this.

7. Termination of the license

The license to the paid features terminates automatically when the paid period ends after the subscription is cancelled, and the account returns to the free plan.

We may suspend or terminate the license early if you violate this agreement: for example, by attempting to reverse engineer the program, bypass limits and protection, resell access, or abuse the free plan. In the event of a material breach, the license may be terminated without a refund, unless the law requires otherwise.

After the license terminates, you must stop using the app and remove it from your devices. The provisions on rights to the program, limitations of liability, and prohibitions remain in force after the license terminates.

You can terminate the agreement at any time: delete the app and cancel the subscription. Refund terms are described in the Refund Policy.

8. Changes to this agreement and contacts

We may update this agreement, for example when new features appear or when the macOS version, which is currently in development, is released. The current version is always published on this page with the date of the update. We will try to announce material changes in advance. By continuing to use the app after changes take effect, you accept the updated terms.
